Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MyVow Fit mobile application (the “App”) provided by MyVow, Inc. (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms.

1.Eligibility

You must be at least 17 years old to use the App. By using the App, you represent that you are 17 or older and have the legal capacity to enter into these Terms.

2.The Service

MyVow Fit is a fitness, nutrition, and personal commitment tracking app that includes AI-assisted coaching, meal planning, food logging, workout tracking, and related features.

3.Subscriptions, Free Trial, and Billing

a. Subscription Plans

The App offers auto-renewing subscription plans, which may include:

  • Monthly subscription: $14.99 per month
  • Annual subscription: $119.00 per year

Prices may change. Any price changes will be communicated in advance and require your acceptance.

b. Free Trial

New subscribers may be offered a 14-day free trial. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee.

c. Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

d. Cancellation

You can manage and cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial periods except as required by applicable law or Apple’s policies.

e. Payment Processing

All payments are processed by Apple through the App Store. Refer to Apple’s terms for refund requests: Apple refund requests

4.Health and Fitness Disclaimer

MyVow Fit is not a medical service. The App provides general fitness, nutrition, and wellness information for educational and personal use only. It is not a substitute for professional medical advice, diagnosis, or treatment.

  • Consult a qualified healthcare professional before beginning any exercise program, changing your diet, or making decisions about your health.
  • The AI assistant (“Sage”) generates suggestions based on patterns and may produce inaccurate or inappropriate information. You are responsible for evaluating any suggestions before acting on them.
  • We do not guarantee any particular health, fitness, or nutrition outcome.
  • If you experience pain, discomfort, or any medical symptoms, stop using the App and consult a healthcare professional.

5.AI-Generated Content

The App uses AI services (provided by Anthropic) to generate responses, meal plans, workout suggestions, and other content. AI output may be inaccurate, incomplete, or unsuitable for your individual circumstances. You use AI-generated content at your own risk and judgment.

6.Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use the App to harass, harm, or impersonate others
  • Circumvent any security or access controls
  • Use automated tools to access the App outside of normal user interaction
  • Submit content to the AI assistant that is illegal, abusive, or designed to manipulate the system to generate harmful output

7.User Content

You retain ownership of any content you create within the App (workouts, vows, meal plans, photos you upload). By submitting content to the AI assistant, you grant us a limited license to transmit that content to AI service providers for the sole purpose of generating a response to you.

8.Intellectual Property

The App, including its design, code, content (other than your user content), trademarks, and the name “MyVow Fit,” is owned by MyVow, Inc. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.

9.Third-Party Services

The App uses third-party services (Apple, Anthropic, FatSecret, USDA, Cloudflare, Fly.io). Your use of those services may be subject to their own terms and policies. We are not responsible for the actions of third-party providers.

10.Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MYVOW, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12.Indemnification

You agree to indemnify and hold MyVow, Inc. harmless from any claims, damages, or expenses arising out of your use of the App, your violation of these Terms, or your violation of any third party’s rights.

13.Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. You may stop using the App at any time by uninstalling it.

14.Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, except where applicable consumer protection law provides for different venue rights.

15.Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by updating the “Effective date” above. Continued use of the App after changes constitutes acceptance of the updated Terms.
